Official Rules for Reel Insights Video Contests

OFFICIAL RULES FOR REEL INSIGHTS VIDEO CONTESTS

GOVERNING RULES. Reel Insights Video Contests (“Contests”) are governed by these Official Rules.  By participating in any given Contest, each entrant into the contest (“Contestant”) unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Reel Insights, which will be final and binding in all respects. The Sponsor of the Contest is Snippies, LLC, 266 West 37th Street, New York, NY 10018 (”Sponsor”).

CONTEST PURPOSE. Reel Insights, a division of Snippies, LLC, conducts contests in which curious people armed with video cameras (Contestants) are offered the opportunity to document, in short videos, their lives, or the lives of family members, friends or community members, in ways that uncover insights and emotions around specific Themes that are potentially of interest in product research, entertainment, and marketing fields, among others; and to submit these “Video Entries” for consideration. The purpose of the Contests is to encourage creation of  these Video Entries which uncover relevant ideas, wisdom and emotions of individuals (“Subjects”) so that this and accompanying footage will be purchased (through the Prizes) from those deemed as the best submissions (“Potential Contest Winners”) for possible license, sale or broadcast by Sponsor for research, broadcast entertainment, marketing, resale or other uses.  Each Contest has a different focus (“Theme”) and includes different required parameters (“Entry Criteria”) but is governed solely by the Official Rules specified in this document.

DEFINITIONS:

  1. Sponsor: The term refers not only to Reel Insights and it’s parent, Snippies, LLC (212-594-9500), but to any of its partners, assignees, designates, and investors.
  2. Official Rules. The terms and conditions expressed within this document (”Official Rules for Reel Insights Video Contests.”
  3. Contest. A specific opportunity for individuals to compete to win defined prizes according to specified parameters.
  4. Official Contest Page. A web page specific to each contest which offers, among other things, the parameters of a specific contest.
  5. Contestant. An individual who has entered by contest by following the rules listed under “How to Enter A Contest” in this document.
  6. Potential Contest Winner. A contestant selected, based on their Video Entry and Submission Package, to receive a specific prize if they are “Certified”.
  7. Contest Winner. A Potential Contest Winner, following Certification, becomes a Contest Winner, and is fully eligible to receive the appropriate Prize.
  8. Subject. Someone who is interviewed, observed, or appears in the Video Entry or Additional Elements Package.
  9. Theme. The broad topic area on which observations and interviews are called to focus. 
  10. Entry. An edited video which is submitted by a Contestant in a specific Contest in hopes of becoming a Contest Winner.
  11. Eligible Entry. An Entry which fulfills all the requirements of these Official Rules, and is thus eligible for consideration as a Potential Contest Winner.
  12. Additional Elements Package. The group of materials, including video files and talent release forms, among others, required for potential Certification.
  13. Prizes. The amount of money and/or other non-monetary items awarded to Contestants who are selected as Potential Contest Winners and are Certified.
  14. Certified. Potential Contest Winners who are deemed, upon Sponsors’ review of their Additional Elements, to have merited winning the Contest, have been Certified.
  15. Disqualified. Contestants who are removed from a given Contest at the discretion of Sponsor, at any stage and for any reason, have been disqualified from that Contest.
  16. Ongoing Disqualification. Contestants who have been disqualified from a given Contest and have been banned from some or all future Contests by Sponsor.
  17. Entry Criteria. The set of requirements for entry into a specific Contest, generally including the Theme, runtime, dates, among other criteria.

ELIGIBILITY REQUIREMENTS FOR POTENTIAL CONTESTANTS.  Contestants must:

  1. Be at least 14 years of age at the time of submission of Video Entry.  Eligible Contestants who are under the legal age of majority in their state / province / locality (”Minors”) must get permission of their parent or legal guardian to participate in the Contest.
  2. Be a member of a video sharing site (such as YouTube) so that their Entry can be posted and viewed for consideration.
  3. Employees, officers and directors of Reel Insights, Snippies, LLC, their parents, subsidiaries, and affiliated companies, advertising, promotion, or production agencies, and web masters/suppliers (collectively, “Contest Entities”), and each of their IRS dependents and immediate family members (spouse, parents, children, siblings) and individuals residing in the same household of each (whether or not related), are not eligible to participate.
  4. All federal, state, and local laws and regulations regarding eligibility for contests apply.
  5. Certain contests are limited to solely to legal residents of the United States or Canada, others are open to Contestants from most anywhere. Consult the Official Contest Page on the website for details on any specific contest’s geographical limits.

TIMELINE OF CONTESTS.  Contests are run with the following target schedule:

  1. Sponsor posts an Official Contest Page which declares its intention to run a Contest.
  2. Entries are accepted during the period posted on the Contest Page (“Entry Posting Period”).
  3. Once the Entry Posting Period has ended the Video Entries are reviewed and Potential Contest Winners are selected (the “Judging Period”).  The Judging Period runs one month or less following the close of the Contest Period.
  4. The Judging Period ends with the selection of Potential Contest Winners. These Potential Contest Winners are notified of their selection (via the email address they provide in their Submission Package) within three business days of that selection (“Notification Period”).
  5. Following the Notification Period, Potential Contest Winners must gather and send the Additional Elements for      their Entry so that it arrives at the Reel Insights office specified within fourteen business days (“Resubmission Period”), in order to be considered for Certification as Contest Winners.
  6. Following the Resubmission Period, Sponsor has ten business days in which to Certify or Disqualify the Potential Contest Winners (“Certification Period”).
  7. Following the Certification Period, Sponsor has 30 days in which to send payment of Prizes to the Contest Winners (see Awarding Prizes Money, below).

HOW TO ENTER A REEL INSIGHTS CONTEST. Follow these steps:

  1. Read through all Rules in this document, and make sure you are both eligible and in agreement with the terms before entering the Contest.
  2. Create an engaging video which follows the Entry Criteria including the Theme of a specific Contest.
  3. Upload your Entry to a video hosting service, such as YouTube, Vimeo, MSN Video, etc.
  4. Carefully enter all details into our Contest Entry Form, which you’ll be taken to by clicking on the “Enter Contest” button from the Reel Insights home page.

You will be notified by email that your entry is received.  This notification will happen before any of your materials have been reviewed or judged.

Contestants must provide all information requested to be eligible to win. Incomplete, unreadable, or unintelligible Video Entries, Additional Elements or any other submitted material may be Disqualified.

Automated entry devices and/or programs are not permitted. Entries generated by a script, macro or other automated means will be disqualified.

Each Contestant must be the rightful owner (or have authorized use) of the video hosting site account associated with the Entry as of the closing date of Entry Posting Period. If there is a dispute as to the identity of a winner, the Sponsor reserves the sole and absolute right to Disqualify the Entry from any award.

DEFINITION OF ELIGIBLE CONTEST ENTRY. For a Entry to be eligible for consideration in the Contest, it must meet these criteria:

  1. It must feature real people, not actors, doing and speaking authentically about real things – not scripted responses or unrealistic situations.
  2. It must enlighten the audience on the Theme.
  3. It must have a production value (picture and sound quality) of acceptable quality.  In judging this, such factors as clarity of sound and video, visibility of subjects and steadiness of camera work will be considered.
  4. It must be uploaded within the time frame designated on the Official Contest Page.  Sponsor uses Eastern Standard Time (USA) in all notations regarding time, and Sponsor is the sole timekeeper.
  5. It must be submitted along with all required information.
  6. It must have a runtime with the parameters noted in the specific contest.
  7. It’s Subjects must fit the Entry Criteria noted on the Official Contest Page.
  8. It must be in English or have easily-readable subtitles in English.
  9. It must NOT include third parties/people, who have not expressly authorized Contestant to display their image, likeness or voice in the Entry or otherwise use such image, likeness or voice in accordance with these Official Rules. Third Parties include but are not limited to celebrities, friends and minors who have not obtained parental consent prior to such participation.
  10. It must NOT contain material which is (or promoting activities which are) sexually explicit, pornographic, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing; or material that contains any derogatory references to any Contest Entities;
  11. Video Entries must not contain the last name, phone number(s), address, or email address or other contact information of any individual, including the Contestant;
  12. It must not contain or otherwise make available any unsolicited or unauthorized advertising, “commercial pitch,” promotional materials, junk mail, spam, pyramid schemes, or any other form of solicitation;
  13. It must not contain or transmit any materials that contain software viruses or other computer code, files or programs designed to impair, limit, interfere with or cause harm to any communications network operated by Sponsor or the computers of any individual or entity participating in or otherwise associated with the Contest;
  14. It must be entirely original to the Contestant and must NOT include mention or performance of any copyrighted media production including but not limited to music, films, books, television programming, etc., or identifying descriptions of any media property, unless the Contestant has express written permission (which must be presented to Sponsor upon request) to use the property in question or the property in question is in the public domain;
  15. It must not have been previously submitted to another contest, broadcast on a media network or submitted to any entertainment entity that would conflict with this Contest, as determined in the Contest Entities’ sole discretion;
  16. It must not include third party trademarks, logos, website URLs, insignia, location signage, photographs, artwork, or sculpture, except for those belonging to Sponsor; and
  17. It must comply with the hosting website’s Terms of Use.
  18. Each Contest can have up to three Entries per Contestant.

DISQUALIFICATION OF VIDEO ENTRIES. Entries will generally be Disqualified if they substantively fail to meet the Official Rules for Reel Insights Video Contests (this document), if they fail to meet the Entry Criteria for a specific Contest, or if the Submission Package, Additional Elements Package or any other required material is deemed to be incomplete or not submitted within expected timeframes.  Disqualifications may occur at any time during the Contest prior to Certification of Contest Winners.  All Disqualifications will be made solely and absolutely at the discretion of Sponsor and the reasoning behind any given Disqualification may or may not be disclosed. Repeated or gross violations of the Official Rules for Reel Insights Video Contest may lead to Disqualification of Contestants from all or a given number of future Contests.  Sponsor will not sell to third parties Video Entries which have been Disqualified. In the event a Entry is Disqualified after it has been selected as a Potential Contest Winner, a new Potential Contest Winner may be named in its place.

SELECTION CRITERIA FOR CHOOSING POTENTIAL CONTEST WINNERS. Eligible Video Entries will be judged on the following Criteria (listed in order of importance):

1) The degree to which fresh insights are presented on the Theme.
2) The degree to which the Subjects (people interviewed and observed) reveal wisdom and emotion on the Theme.
3) The degree to which the situations and Subjects look, sound (and, in fact, are) real.
4) The way in which these clips are woven into a video with a beginning, middle and end (a story).
5) The quality of the footage, both in terms of video and audio clarity. (Note: This is above and beyond the “Acceptable Quality” standard noted in these Rules; i.e. Video Entries must feature clear video and audio, plus a steady hand, for consideration as Potential Contest Winners.)

SELECTION PROCESS FOR CHOOSING POTENTIAL CONTEST WINNERS. Eligible Video Entries are viewed by a three judge panel which generally includes professionals in the areas of video anthropology/ethnography, and market/consumer research. The judges may or may not be employees of (or in other ways affiliated with) the Sponsor or parent or related entities, including Contest Entities. The panel will assign initial scores based on the Selection Criteria noted in this document. Top scoring Eligible Video Entries will be reviewed in at least one additional round which potentially includes discussion and debate among the judges. A final scoring will determine the Potential Contest Winners.  In the event of a tie, and additional judge may be called in to make the determination, based on the same Selection Criteria listed herein.

REQUIREMENT OF POTENTIAL CONTEST WINNERS TO SUBMIT ADDITIONAL ELEMENTS PACKAGE. Potential Contest Winners are required to submit the following complete package of materials (“Additional Elements”) in order to be considered for Certification as Contest Winners.  These Additional Elements must be received at the Reel Insights office within twelve (12) business days of Contestant’s Notification of being a Potential Contest Winner, or fifteen (15) business days if the Filmmaker lives outside of the United States.  Failure to do so will most likely result in Disqualification of the Video Entry.

Additional Materials – Videos

  1. The original submitted video in its highest-quality, uncompressed format.
  2. The raw footage, in its highest quality format, of all interviews and observational video related to the submitted video. This footage must be highly relevant to the video produced and theme of the contest, and must be at least 30 minutes in length.
  3. Video showing all signings of the documents below taking place (Talent Releases, Rights Transfer Agreements and Agreement with the Official Rules).

Additional Materials – Documents

  1. Signed Talent Release forms from all Subjects (anyone appearing in the foreground of the video or speaking in a manner that is substantive to the content of the video).  To help Reel Insights verify that these Talent Release forms are legitimate, the actual signing of the form must be recorded on video and included in the submitted videotape.  If the respondent is a minor, the signature of a parent or legal guardian must be submitted as well, along with video recording of that submission.
  2. Signed Rights Transfer Agreements  by any individuals involved in the filming, editing or other aspects of producing the Submitted Video or the Raw Footage.  This does not include the Subjects of the video (i.e. people interviewed or observed), unless they were also involved in the production in some way.
  3. An reiteration of Agreement to these Official Rules (all contestants will have already indicated their agreement by clicking “I do” when submitting their entries — this is simply a reiteration of that agreement).
  4. A Publicity Release, unless barred by local law.
  5. IRS Form W-9 from all people considered “United States Persons” for tax purposes (primarily: 1) US Citizens no matter where they live, and 2) residents of the United States).
  6. Other related documents as necessary.

In addition to the above, Contestants should provide all appropriate clearances, permissions and releases for the Video Entry, including all permissions for the use of third party intellectual property (such as music, graphics and copyrighted text, among others) and location releases for recognizable locations, where a release is required. In the event a Contestant cannot provide all required releases, Sponsor reserves the right, in Sponsor’s sole discretion, to Disqualify the applicable Video Entry.

In the event a Potential Contest Winner is a Minor, all documents requiring a Contestant signature, including Additional Materials documents, must also be signed by the Minor’s parent/legal guardian on his or her behalf.

All requested documents will need to be properly executed before Certification can be considered. Failure to submit properly executed documents within the required timeframes will result in likely Disqualification of the Video Entry.

HOW POTENTIAL CONTEST WINNERS MUST SUBMIT THEIR ADDITIONAL ELEMENTS PACKAGE. Additional Elements Packages can be sent by mail to Reel Insights, A Division of Snippies, 266 W37th Street, Suite 1600, New York, NY 10018, including the footage on recordable media (like DVDs, Flash Drives or CDs) and the signed originals of required contest papers, or by the internet via FTP or related services, including the footage is uploaded video files, and the signed required contest papers as scanned documents (like PDFs or JPGs). Instructions will be supplied to the Potential Contest Winners. Sponsor is not liable for any delays, loss or damage of materials shipped from or to the Contestant by any means.

VERIFYING CONTEST WINNERS. Reel Insights will review the Additional Elements within ten business days of their receipt, or sooner.  At its sole and absolute discretion, Reel Insights will then either Certify that the Potential Contest Winner has fulfilled the obligations detailed in this document, and related documents if applicable, and thereby declare the Potential Contest Winner an actual Contest Winner of this specific Contest; or Disqualify the Potential Contest Winner and the associated Video Entry.

PAYMENT OF PRIZES TO CONTEST WINNERS. Once Potential Contest Winners have been Certified as Contest Winners, prize money will be sent as a check to the Contest Winner, at the address provided in the original Submission Package, postmarked in no more than 30 days.

REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION: Every individual entering this Contest represents and warrants the following: (1) the Entry is the Contestant’s own original, previously unpublished, and previously unproduced work; (2) the Entry does not contain computer viruses, is not otherwise uncorrupted, is wholly original with Contestant, and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (3) the Entry does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; and (4) the Entry does not and will not violate any applicable laws, and is not and will not be defamatory or libelous. Each Contestant hereby agrees to indemnify and hold the Contest Entities harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of Contestant hereunder.

GRANT OF LIMITED RIGHTS FROM ALL CONTESTANTS: Contestants entering a Contest maintain all rights to their Entry and all associated elements until the Certification process for those judged as Potential Contest Winners.  However, by entering the Contest the Contestant grants Reel Insights rights to post the video on websites, in broadcast and any other media as an Entry to the Contest, including on advertising-supported media. However, Reel Insights does not have the right to sell the Entry itself or rights to the Entry.

GRANT OF RIGHTS FROM POTENTIAL CONTEST WINNERS: To be Certified as a Contest Winner, Potential Contest Winners irrevocably grant, transfer, sell, assign and convey to the Sponsor, their successors and assigns, all present and future right, title and interest of every kind and nature whatsoever, including, without limitation, all copyrights, and all rights incidental, subsidiary, ancillary or allied thereto (including, without limitation, all derivative rights) in and to the Entry for exploitation throughout the universe, in perpetuity, by means of any and all media and devices whether now known or hereafter devised. Sponsor shall have the right, in their sole discretion, to edit, composite, morph, scan, duplicate, or alter any and footage submitted by Potential Contest Winners for any purpose which Sponsor deems necessary or desirable, and each Potential Contest Winner irrevocably waives any and all so-called moral rights they may have therein. Potential Contest Winners acknowledge that he/she does not reserve any rights whatsoever in or to the Entry.

PUBLICITY RELEASE: By participating in the Contest, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any Contestant in or winner of the Contest, each Contestant (and in the event an Contestant is a Minor, his/her parent/legal guardian on his/her behalf) irrevocably grants the Contest Entities and their respective successors, assigns and licensees, the right to use such Contestant’s name, likeness, biographical information and Video Entry in any and all media for any purpose, including without limitation, advertising and/or promotional purposes as well as in, on or in connection with the Website or the Contest or other promotions, and hereby release the Sponsor from any liability with respect thereto.

PRIZES: Prizes will be noted on the Contest Page. These will be paid to Contest Winners following their Certification. Sponsor reserves the right to award prizes only to entries it considers worthy of being Potential Contest Winners, even if this means that fewer or no prizes are awarded in a particular contest.

GENERAL CONDITIONS: Sponsor reserves the right to alter the Contest Rules, in whole or in part, and to immediate and retroactive effect, at any point during the Contest until the Certification of all Contest Winners.  This includes altering the number of prizes awarded or cancelling a particular contest or contests. Contestants (and, in the case of a Minor, Contestant’s parent/legal guardians on Contestants’ behalf) agree (a) that the Contest Entities, and their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, agents, successors and assigns (collectively, the “Releasees”) are released, will have no liability whatsoever for, and shall be held harmless by Contestants against any liability for any injuries, losses, damages, costs or expenses of any kind to person(s), including without limitation, personal injury and/or death, or property damage resulting in whole or in part, directly or indirectly, from Contestant’s preparation for, travel to or participation in the Contest, or acceptance, possession, misuse or use of the prizes or participation in any Contest related or travel related activities and for claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Potential Contest Winners will be required to complete, sign, assemble and return the Additional Elements Package within the time specified after their notification of being Potential Contest Winners. In the event a Potential Contest Winner is a minor, any necessary documents from the Additional Elements Package must also be signed by the Minor Potential Contest Winner’s parent/legal guardian on his/her behalf. If documents are not returned within the required time frames, or if any notification or prize is returned as non-deliverable, or if no response is received when attempting to notify a Potential Contest Winner, or if a Potential Contest Winner is found to be ineligible or otherwise not in compliance with these Official Rules, prize will be forfeited and an alternate Potential Contest Winner determined. Taxes on prize are solely the Contest Winner’s responsibility. 

LIABILITY LIMITATIONS: The Sponsor and Releasees are not responsible for lost, late, misdirected, incomplete, or non-delivered entries or e-mail; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Contest or otherwise attempt to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other Contestants or Sponsor representatives, as solely determined by Sponsor, will be disqualified. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods, and disqualify any Contestant using such methods. Releasees are not responsible for injury or damage to Contestants’ or to any other person’s computer related to or resulting from participating in this Contest or downloading materials from or use of the Website. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserve the right at their sole discretion to suspend, modify or terminate the Contest, and select the winners from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Releasees are not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest, and assume no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use of this website. In case of dispute of the identity of the Contestant, the determination of identity will be the sole decision of Sponsor, and Sponsor reserves the right to Disqualify the Video Entry and all of those claiming to be the Video Entry’s creator.

In no event will Releasees be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the Website or downloading from and/or printed material downloaded from said Website. Without limiting the foregoing, everything on the Website is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions.

WINNERS LIST: For the names of the winners, write your name and complete address on a 3″x5″ card and mail in a first-class stamped envelope to: Reel Insights Contests, c/o Snippies, 266 West 37th Street, Suite 1600, New York, NY 10018.  Requests must be received within six months of a given Contest concluding.
